Security and Exposure Management for Law Firms
01Context
Law firms hold concentrated, high-value information: transaction terms before announcement, litigation strategy, and privileged communications. Corporate clients now impose their own security requirements on outside counsel, and professional conduct rules require reasonable efforts to protect client information.
02How it is typically done
Firms respond to client security questionnaires and outside counsel guidelines one at a time, usually through the IT director and a partner who reviews answers. Security is assessed through annual audits or insurer applications. Payment instructions are often verified by email reply.
03Where that breaks down
- The same questionnaire is answered dozens of times with inconsistent wording, and answers drift from actual practice.
- Business email compromise targets closings, settlements, and escrow disbursements, where one altered wire instruction can be catastrophic.
- Credentials belonging to attorneys and staff appear in breach and infostealer data without the firm's knowledge.
- Vendors with access to matter data, such as eDiscovery, court reporting, and translation providers, are rarely reassessed.
